NSW Supreme Court rejects clean-up notice damages claim

A clean-up notice that resulted in a chemical company suspending operations was invalid and might have been issued by an unauthorised council officer, but the company was not entitled to damages because it was not owed a duty of care, the NSW Supreme Court has ruled.
